1. Acceptance of Terms

By downloading, installing, or using LingoCapture (the "Service," "App," or "we"), you agree to these Terms of Use ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

LingoCapture is a mobile application distributed on the Apple App Store and Google Play. These Terms apply to your use of the native app and related services we operate.

2. Description of Service

LingoCapture is a language-learning application for iOS and Android that may use your device camera, microphone, and cloud AI services to help you practice a target language. Core experiences include:

Scan — point your camera at objects, text, or menus for AI-assisted translation and learning context (results are generative estimates, not certified translations)
Feed — generated lesson-style vocabulary and phrase practice
LingoDex — save words and phrases you choose to keep
Chat — AI conversation practice (where available in the app)
Arcade — language games (where available in the app)

Feature availability, limits, and languages offered may change over time and can differ between Free and Pro tiers.

3. Accounts, Guest Browse, and Eligibility

3.1 Age Requirements

You must be at least 13 years old to use LingoCapture. If you are between 13 and 17, you must have parental or guardian consent where required by law.

3.2 Guest Browse (No Account)

You may browse parts of the app interface without signing in. Guest browse is for exploring the layout and UX only.

Guest browse does not create a permanent account and does not unlock product features that require sign-in, including Feed generation, Scan, Chat, Arcade, and cloud sync.

To use those features and save progress across devices, sign in with an account method offered in the app (such as Google, Apple, or Facebook, depending on platform and configuration).

3.3 Account Creation

When you sign in, you create or access a LingoCapture account tied to your credentials. You agree to:

Provide accurate information where requested
Keep your sign-in credentials secure
Notify us promptly of unauthorized access you become aware of
Accept responsibility for activity under your account

3.4 Account Suspension by Us

We may suspend or terminate accounts that violate these Terms, engage in fraud or abuse, or remain inactive for an extended period, subject to applicable law and app-store policies.

4. Acceptable Use

4.1 You MAY

Use LingoCapture for personal language learning
Capture images of objects, signs, or text for in-app learning (where the feature is available to you)
Save content you choose to your LingoDex and export local backups where the app provides those controls

4.2 You MAY NOT

Use the Service for unlawful purposes
Capture or share inappropriate, offensive, or private images of others without permission
Reverse engineer, decompile, or attempt to extract source code except where law expressly permits
Use bots, scrapers, or automated means to access the Service
Circumvent usage limits, paywalls, or security controls
Impersonate others or create misleading accounts
Upload malware or interfere with the Service or its users

5. Intellectual Property

5.1 LingoCapture IP

The App, branding, and our original content are owned by LingoCapture or our licensors and protected by intellectual-property laws.

5.2 Your Content

You retain ownership of images and learning content you create in the app. You grant us a limited license to process that content only as needed to operate the Service (for example, to run scan or feed features you request).

5.3 Trademarks

"LingoCapture" and related marks are our trademarks. You may not use them without prior written permission.

6. AI-Generated Content and Translation Accuracy

6.1 Generative AI

LingoCapture uses AI and machine learning for translations, lessons, chat, and related outputs. AI results:

May be incorrect, incomplete, or contextually wrong
Are learning aids, not professional, certified, or authoritative translations
Should be verified before you rely on them in real-world situations

6.2 Not for High-Stakes Use

Do not rely on LingoCapture for legal, medical, safety-critical, immigration, financial, or official certified translation needs.

7. Subscriptions and Payments (Free and Pro)

7.1 Plans

LingoCapture offers:

Free — limited access according to in-app limits shown in the app
Pro — a paid auto-renewable subscription (and/or other in-app purchase products we offer from time to time) that unlocks additional features and higher limits as described in the app

We offer two user-facing tiers: Free and Pro. There is no separate third subscription tier in the app.

7.2 Purchase and Billing

Paid plans are sold through the Apple App Store or Google Play (via in-app purchase)
Subscription name, length, price, and price per unit (if applicable) are shown in the app before you purchase and on the store product page
Subscriptions auto-renew unless you cancel through your Apple or Google account settings before the renewal date
Payment, renewal, cancellation, and refunds are handled under the applicable store's terms and refund policies
We may change pricing or plan structure where permitted by the store and applicable law; changes apply as described by the store and/or in-app notice

7.3 Restore Purchases

If you reinstall the app or change devices, use Restore Purchases (or equivalent) in the app and ensure you are signed in with the same store account used for the original purchase.

7.4 Promotions

Discounted or promotional pricing applies only when we clearly offer it in the app or store listing.

8. Limitation of Liability

8.1 Service Availability

We do not guarantee uninterrupted service, compatibility with every device, or permanent availability of any feature.

8.2 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8.3 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINGOCAPTURE AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) CAD $100 IF YOU HAVE NOT PAID FOR A SUBSCRIPTION.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

9. Camera, Microphone, and AR Usage

9.1 Responsible Use

When using camera or AR features, you are responsible for:

Respecting the privacy and rights of others
Complying with local laws on photography and recording
Staying aware of your surroundings
Not using the camera while driving or in dangerous situations

9.2 Device Permissions

The app requests camera and/or microphone access only for features that need them. You can deny or revoke permissions in device settings; related features may not work without permission.

10. Third-Party Services

The Service relies on third parties (for example, cloud hosting, authentication, analytics, crash reporting, AI providers, and app-store billing). Those providers operate under their own terms and privacy policies. We are not responsible for third-party services outside our reasonable control.

11. Indemnification

You agree to indemnify and hold LingoCapture harmless from claims, damages, and reasonable legal fees arising from your misuse of the Service, your violation of these Terms or applicable law, or content you submit through the Service, to the extent permitted by law.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated version at https://www.lingocapture.com/TermsofUse and update the "Last updated" date. Material changes may also be communicated through the app or by email where appropriate. Continued use after changes take effect constitutes acceptance of the revised Terms, where permitted by law.

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules.

13.2 Dispute Resolution

Contact us first at [email protected] so we can try to resolve the issue in good faith. If we cannot resolve a dispute, it may be brought in the courts of Ontario, Canada, or another forum permitted by applicable law.

13.3 Class Action Waiver

To the extent permitted by law, you agree to bring claims against us only on an individual basis, not as a plaintiff or class member in a class, collective, or representative proceeding.

14. Termination and Account Deletion

14.1 Ending Your Use

You may stop using the Service at any time by uninstalling the app.

If you have a signed-in account, you may permanently delete your account and associated personal data we hold from the app:

Open the Menu
Tap Account & privacy
Tap Delete account
Confirm the deletion prompt

You can also request deletion by emailing [email protected] from the email on your account or with enough information for us to verify ownership.

Deleting your LingoCapture account does not cancel an App Store or Google Play subscription. Cancel billing in your Apple or Google account settings before or after account deletion.

14.2 Termination by Us

We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service.

14.3 Effect of Termination

Upon termination, your right to use the Service ends. We may delete or retain data as described in our Privacy Policy and as required by law. Sections that by their nature should survive termination will survive.

15. Miscellaneous

15.1 Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and LingoCapture regarding the Service.

15.2 Severability

If any provision is unenforceable, the remaining provisions remain in effect.

15.3 No Waiver

Our failure to enforce a provision is not a waiver of that provision.

15.4 Assignment

You may not assign your rights under these Terms without our consent. We may assign ours to an affiliate or successor.

15.5 Force Majeure

We are not liable for delay or failure caused by events beyond our reasonable control.
