By accessing or using LingoCapture ("the Service," "the App," or "we"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

2. Description of Service

LingoCapture is an augmented reality (AR) language learning application that uses your device's camera to:

Identify objects in real-world environments
Provide instant translations in your target language
Create personalized vocabulary collections
Offer gamified learning experiences
Enable AI-powered conversation practice

3. Pre-release testing (when offered)

3.1 Development status

LingoCapture is in development and is not distributed as a finished, generally available app on the Apple App Store or Google Play at the time these terms were last updated. Marketing and this website may describe planned features that are not yet available in any build you can install. If we invite you to private testing, a preview, or a beta, the following sections apply for the duration of that access.

3.2 Test participation

If you participate in any invited testing, you agree to:

Provide constructive feedback about your experience when asked
Report bugs and technical issues when encountered
Not disclose confidential features or information publicly (if we mark them confidential)

3.3 Ending testing or access

We reserve the right to:

End a test program at any time
Remove testers from a test program
Introduce paid plans after a public launch when we choose to do so

4. User Accounts and Eligibility

4.1 Age Requirements

You must be at least 13 years old to use LingoCapture. Users between 13-17 must have parental consent.

4.2 Account Creation

To access certain features, you may need to create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Be responsible for all activities under your account

4.3 Account Termination

We reserve the right to suspend or terminate accounts that:

5. Acceptable Use

5.1 You MAY:

Use LingoCapture for personal language learning
Capture images of objects, signs, and text for translation
Share your learning achievements on social media

5.2 You MAY NOT:

Use the Service for illegal activities
Capture or share inappropriate, offensive, or private images
Reverse engineer, decompile, or attempt to extract source code
Use automated bots or scripts to interact with the Service
Harass, abuse, or harm other users
Circumvent any access restrictions or security measures
Upload malicious code or viruses
Impersonate others or create fake accounts

6. Intellectual Property

6.1 LingoCapture IP

All content, features, and functionality are owned by LingoCapture and protected by:

Copyright laws
Trademark laws
Patent laws
Other intellectual property rights

6.2 User Content

You retain ownership of images and content you create. By using the Service, you grant us:

A limited license to process your images for translation
Permission to use anonymized learning data to improve the Service
Right to display your public achievements (if you choose to share them)

6.3 Trademarks

"LingoCapture," the LingoCapture logo, and other marks are trademarks of LingoCapture. You may not use our trademarks without prior written permission.

7. Translation Accuracy

7.1 AI-Powered Translations

LingoCapture uses AI and machine learning for translations. While we strive for 100% accuracy:

Translations may occasionally be incorrect or imprecise
Context-specific nuances may not always be captured
We are not liable for miscommunications resulting from translation errors

7.2 Not for Legal or Medical Use

Do not rely on LingoCapture for:

Legal document translation
Medical or health-related communications
Safety-critical situations
Official or certified translations

8. Subscription and Payments

8.1 Pricing during development

While LingoCapture is in development or offered only through invited testing, access may be free or subject to separate terms we communicate for that program. When we launch paid plans on app stores, pricing and billing will follow the store’s checkout and the terms shown there.

8.2 Future Paid Plans

Upon official launch, we may introduce paid subscription tiers:

Free tier with limited features
Premium tiers with enhanced capabilities
Pricing will be communicated in advance

8.3 Billing Terms (Future)

When paid plans are introduced:

Subscriptions will auto-renew unless cancelled
Refunds will be subject to our refund policy
Prices may change with 30-days notice

8.4 Promotional pricing

If we run promotions, early supporters or invited testers may receive benefits such as discounted pricing, grandfathered pricing, or extra features—only if we announce and offer them.

9. Limitation of Liability

We do not guarantee:

Uninterrupted or error-free service
Compatibility with all devices
Specific accuracy rates for translations
Availability of specific features

9.2 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.3 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINGOCAPTURE SHALL NOT BE LIABLE FOR:

Indirect, incidental, or consequential damages
Loss of data, profits, or business opportunities
Damages exceeding the amount you paid for the Service (currently $0 while no paid subscription applies)

10. Camera and AR Usage

10.1 Responsible Camera Use

You are responsible for:

Respecting others' privacy when capturing images
Complying with local laws regarding photography
Being aware of your surroundings while using AR features
Not using the camera while driving or in dangerous situations

10.2 Location-Based Services

If you enable location services:

We may collect location data to enhance features
You can disable location access in your device settings
Some features may require location access to function

11. Third-Party Services

LingoCapture integrates with third-party services:

AI translation providers
Cloud storage services
Social media platforms (for sharing)
Analytics services

These services have their own terms and privacy policies. We are not responsible for third-party services.

12. Indemnification

18. Invited testing (if applicable)

If you receive access to a private test, preview, or beta build, you additionally agree to:

Some test features may be confidential. Do not disclose:

Unreleased features or roadmap information
Performance metrics or technical details
Private test-only communications

18.2 No expectation of compensation

Test access is for evaluation. You are not entitled to:

Monetary compensation for feedback
Free lifetime access after launch
Special treatment or priority support

(Unless explicitly stated in a separate testing agreement.)

18.3 Data during testing

We will make reasonable efforts to:

Preserve your learning data when moving from testing to a public release
Notify you of any data migration requirements
Provide export options before significant changes

However, we cannot guarantee data preservation during pre-release testing.
